Terms and Conditions

1. Sale and Purchase of Goods 

Quvira by Riya ("Seller") hereby agrees to sell, and You ("Buyer") hereby agree to purchase, goods of the description and quantity described on the checkout window ("Checkout") and incorporated herein by this reference ("Goods") on the terms and conditions set forth in this Agreement. 

2. Purchase Price 

Buyer agrees to pay the Purchase Price of the Goods as posted on this website. All prices are listed in Indian Rupees (INR) unless otherwise stated. For international orders, the equivalent amount will be charged in your local currency at the prevailing exchange rate at the time of purchase. 

3. Payment Terms 

The total amount of the Purchase Price shall be payable in full by Buyer according to the payment due date stated at Checkout. Seller shall have the right to pursue any remedies available at law or as provided herein and shall be entitled to reimbursement from Buyer for Seller's costs of collection, including attorney fees, legal fees, costs and disbursements, if any. 

4. Order Confirmation and Cancellation 

Once an order is placed, Buyer will receive an order confirmation via email. This confirmation acknowledges receipt of the order and does not constitute final acceptance of the order. Quvira by Riya reserves the right to cancel any order at its sole discretion, including but not limited to cases of pricing errors, stock unavailability, suspected fraud, or non-compliance with our policies. 

If an order has not yet been processed or shipped, Buyer may request a cancellation within 24 hours of placing the order by contacting us at info@quvirabyriya.com. Approval of cancellation requests is at Quvira by Riya's sole discretion. Once an order has been processed and shipped, it cannot be cancelled and the Buyer must follow the return process as set out in our Return Policy. 

Buyers will receive an order tracking link via email or SMS once the order has been dispatched. 

5. Delivery 

Unless otherwise agreed in writing, delivery shall be made in accordance with Seller's shipping policy in effect on the date of shipment. Delivery dates provided by Seller are estimates only and no time frame is guaranteed. Seller will make reasonable efforts to deliver in accordance with such dates; however, Seller will not be liable for failure to deliver as estimated. Goods shall be packaged according to Seller's standards and practices unless otherwise agreed in writing. 

6. Customs, Duties, and Taxes 

Quvira by Riya is based in India. The price you pay at checkout covers the product cost, applicable taxes, and shipping charges only. 

Orders shipped to countries outside India may be subject to import duties, customs fees, and other charges levied by the destination country's authorities at the port of entry. These additional charges are entirely the responsibility of the Buyer. Quvira by Riya has no control over these charges and cannot predict what they may be. 

The recipient is the importer of record and must comply with all laws and regulations of the destination country. By placing an order for international delivery, the Buyer acknowledges and accepts full responsibility for any and all charges imposed at the port of entry, including but not limited to customs duties, import taxes, brokerage fees, and inspection fees. 

If a shipment is refused or unclaimed due to the Buyer's refusal to pay applicable customs charges, Quvira by Riya reserves the right to recover the cost of the original shipment and any return shipping from the Buyer. 

Customs clearance procedures may cause delays beyond our original delivery estimates. For specific customs requirements, the recipient should contact their local customs office prior to placing an order. 

7. Returns and Exchanges 

Please refer to our Return Policy for full details on eligibility, timelines, and the process for returning or exchanging products. We reserve the right to refuse returns or exchanges that do not comply with our stated Return Policy. 

8. Damage on Delivery 

The buyer is responsible for inspecting all goods upon delivery. Should you discover any manufacturer defect or damage upon receipt of your order, please notify us immediately at info@quvirabyriya.com with photographic evidence of the damage. Claims for damage or defects reported after 48 hours of delivery confirmation may not be accepted. 

Quvira by Riya will assess each claim on a case-by-case basis and, where a valid claim is confirmed, will offer a repair, replacement, or store credit at our discretion. We reserve the right to arrange collection of the damaged item before processing any resolution. 

9. Handmade and Natural Variation Disclaimer 

Many of Quvira by Riya's products are handcrafted or made using natural materials. As a result, each piece is unique. Slight variations in colour, texture, size, and finish are an inherent characteristic of handmade and artisanal goods and are not considered defects. Dimensions of handmade products may vary marginally from those stated on the website. These natural variations are part of what makes each piece special and are not grounds for return or exchange. 

10. Colour Disclaimer 

The colours of products you see on your screen will vary slightly from those of the actual product. This is because of the difference in underlying technologies of computer monitors and fabric; monitors that are not properly calibrated also contribute to the difference in colours. The lighting used while taking photographs also affects the final colour shown on screen. If you have a question about the colour or finish of a specific product before placing your order, please contact us and we will do our best to assist. 

11. Price Disclaimer 

While Quvira by Riya makes every effort to ensure that products are described and priced accurately, in the event that an item is deemed to be priced incorrectly whether due to a typographical or written error, Quvira by Riya reserves the right to refuse or cancel the sale of that item. All such errors are subject to correction. In the event of a cancellation where payment has already been made, a full refund will be issued. Quvira by Riya is not responsible for typographical or written errors made in any quotations, orders, or publications. 

12. User-Generated Content 

If you submit any content to us or our website — including but not limited to reviews, comments, photographs, feedback, or other materials — you grant Quvira by Riya a non-exclusive, royalty-free, perpetual, irrevocable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media, including on our website and social media channels, for marketing and promotional purposes. You represent and warrant that you own or control all rights to the content you submit, that the content is accurate, and that its use by Quvira by Riya will not violate these Terms or infringe the rights of any third party. 

13. Buyer Representations 

By placing an order with Quvira by Riya, Buyer represents and warrants that they will not make any false or misleading statement concerning Quvira by Riya or any of its products; not make any representation, warranty, or guarantee regarding our products that is inconsistent with or absent from our product descriptions; and comply with all applicable laws and regulations in their jurisdiction in connection with the purchase and use of our products. Buyer agrees to indemnify and hold harmless Quvira by Riya from all damages, losses, and costs arising out of Buyer's breach of the foregoing representations and warranties.  

14. Intellectual Property 

All content on this website, including but not limited to text, photographs, graphics, product designs, and branding, is the property of Quvira by Riya and is protected under applicable Indian intellectual property laws and international copyright law. You may not reproduce, distribute, or use any content from this website without prior written consent from Quvira by Riya. 

This prohibition expressly includes the use of automated tools, web scrapers, AI training pipelines, or any other technology to extract, copy, or reproduce our content, product imagery, pricing data, or design assets for any commercial purpose, including training or fine-tuning artificial intelligence or machine learning models. 

15. Third-Party Links and Tools 

Our website may contain links to third-party websites or use third-party tools. We are not responsible for the content, privacy practices, or accuracy of any third-party websites. Access to such websites is entirely at your own risk. We do not endorse any third-party website or service unless explicitly stated. 

16. Prohibited Uses 

In addition to other prohibitions set forth in this Agreement, you are prohibited from using the site or its content for any unlawful purpose; to violate any laws in India or your jurisdiction; to infringe upon our intellectual property rights or those of others; to harass, abuse, or discriminate against any person; to submit false or misleading information; or to transmit any harmful, fraudulent, or malicious code or content. 

17. Online Store Terms 

By agreeing to these Terms of Service, you represent that you are at least 18 years of age, or that you are the age of majority in your jurisdiction and have provided consent for any minor dependents to use this site. A breach or violation of any of these Terms will result in an immediate termination of your access to our Services. 

18. Modifications to the Service and Prices 

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue any part of the Service without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service. 

19. Disclaimer of Warranties and Limitation of Liability 

Quvira by Riya disclaims all warranties and conditions, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. 

Under no circumstances shall Quvira by Riya, its affiliates, or their respective employees, directors, officers, or agents be liable for any damages of any kind arising out of or in connection with any order, products, or services. This is a comprehensive limitation of liability that applies to all losses and damages of any kind — whether general, special, consequential, incidental, or exemplary, including without limitation loss of data, income, or profits — whether in contract or tort, even if we have been advised of the possibility of such damages. 

Notwithstanding the foregoing, Quvira by Riya's total liability arising out of this Agreement shall not exceed the total amount paid by Buyer in connection with the product or products giving rise to the applicable claim.

20. Waivers and Errors 

Any order that contains terms and conditions in addition to or inconsistent with these Terms will not be binding upon Quvira by Riya unless acceptance of each such term or condition is clearly and expressly agreed to in writing. Failure by Quvira by Riya to object to any provision in any communication from Buyer shall not be construed as a waiver of these Terms or as acceptance of any such provision.

21. Force Majeure 

In the event either party is prevented from performing its obligations under this Agreement by circumstances beyond its reasonable control, including without limitation strikes, lockouts, fire, explosion, flood, disruption of supply, acts of God, war or other hostilities, acts of terrorism, banking or systemic economic failure, riot or civil commotion, government embargoes, acts or regulations, breakdown of machinery, or inability to obtain shipping facilities or supplies the obligation of Quvira by Riya to deliver and the obligation of Buyer to accept delivery shall be suspended for the duration of such circumstances, and the affected obligations shall be cancelled without liability to either party, or reasonable extensions of time for performance will be granted. This provision does not relieve Buyer of the obligation to pay for any products that have already been delivered.

22. Fraudulent Damage Claims and Misuse of Artificial Intelligence 

Quvira by Riya takes fraudulent claims seriously. Any attempt to deceive, manipulate, or mislead us in connection with a damage, defect, or return claim is a violation of these Terms and may result in the immediate cancellation of the claim, permanent suspension of the Buyer's account, and legal action where warranted. 

In particular, Quvira by Riya expressly prohibits the following: 

• Using artificial intelligence tools, image editing software, or any other technology to fabricate, alter, or manipulate photographs or videos submitted as evidence of damage or defects
• Submitting digitally generated, deepfake, or otherwise artificially created or modified imagery to support a claim
• Using AI-generated text, scripts, or automated tools to submit false, exaggerated, or misleading complaints, reviews, or claims
• Deploying bots, automated systems, or AI-driven tools to exploit our returns, refunds, or customer service processes
• Using AI tools to scrape, copy, reproduce, or systematically extract content, product data, pricing, or imagery from our website without prior written consent 

Where Quvira by Riya reasonably suspects that AI tools or image manipulation have been used to falsify a claim, we reserve the right to reject the claim outright, request independent verification, and report the matter to relevant authorities. The burden of proving the authenticity of any submitted evidence lies with the Buyer. Quvira by Riya itself may use AI tools for fraud detection, image authentication, and claim verification purposes. 

23. General 

Buyer may not assign this Agreement without Seller's written consent. If there is any inconsistency between this Agreement and any other agreement relating to the Goods, this Agreement shall govern. This Agreement may not be modified, altered, or amended without the written agreement of Seller. If any term of this Agreement is illegal or unenforceable, the legality and enforceability of the remaining provisions shall not be affected or impaired. This Agreement shall be interpreted under the laws of India, without giving effect to conflicts-of-law rules. In the event of a dispute under this Agreement, Buyer submits to the exclusive jurisdiction of the courts of India and hereby waives any objection to such jurisdiction and venue.
